These Terms are a legal agreement between you and the independent developer who operates Herdz.io ("we", "us", "our"). They govern your use of the Herdz.io game and website at herdz.io and all related features and services (the "Game"). Please read them carefully. By using the Game you accept these Terms; if you do not agree, do not use the Game. Please also read our Privacy Policy.

1. Who we are & how to contact us

The Game is operated by an independent solo developer based in the European Union (Germany). For support, abuse reports, or intellectual-property complaints: support@herdz.io. For data-protection requests: privacy@herdz.io.

2. Acceptance & changes

By using the Game, you agree to be legally bound by these Terms. We may update them from time to time; the current version is always posted here. For significant changes we will provide notice in the Game or on the website, and you may be asked to accept the revised Terms. Continuing to use the Game after changes take effect means you accept them.

3. Eligibility & age

You must be at least 13 years old to use the Game. If you are under the age of majority in your country, you may use the Game only with the consent of a parent or legal guardian, who must agree to these Terms on your behalf. To make purchases you must be 18 or older, or have your parent's or guardian's permission.

4. Your account & security

You can play anonymously — a unique identifier is stored on your device — or sign in with Google or Facebook to save your progress across devices. You are responsible for keeping your device and sign-in credentials secure and for activity that happens under your account. Accounts are for a single person; you must not share, sell, or transfer your account. If you believe your account has been accessed without your permission, contact us. 5. Rules of conduct & fair play

When using the Game, you agree not to:

choose a username or display name that is offensive, hateful, harassing, sexually explicit, impersonates another person or entity, infringes anyone's rights, or contains personal information;
cheat, or use, create, or distribute bots, hacks, exploits, cheats, mods, scripts, or any unauthorised third-party software that modifies or automates the Game;
reverse engineer, decompile, or disassemble the Game, or attempt to access its source code, except to the extent the law expressly permits;
tamper with, disrupt, or place an undue load on the Game or its servers, or interfere with other players' enjoyment;
attempt to gain unauthorised access to other players' accounts or to the in-game economy (for example, to mint, duplicate, or transfer currency or items by improper means);
harass or abuse other players or our staff; or
use the Game for commercial purposes without our written permission.

We monitor use of the Game by automated and manual means. We may rename usernames, remove content, and suspend or terminate accounts that breach these Terms. Where we detect fraudulent or criminal activity, we may investigate and, where appropriate, notify the relevant authorities.

6. Ownership & your licence to play

All content in the Game — including its code, graphics, designs, logos, animations, text, and the Herdz.io name and brand — is owned by or licensed to us and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Game for your own personal, non-commercial entertainment, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Game except as the law allows or we expressly permit. We do not object to players sharing personal, non-commercial gameplay footage in good faith, provided it is not associated with offensive, harmful, or illegal content.

7. Your content

The only content you create in the Game is your username / display name. You keep ownership of it, but by using it you grant us a worldwide, royalty-free licence to display it within the Game and related materials. You confirm you have the right to use it and that it complies with the Rules above. We may remove or change a username that breaches these Terms.

8. Bots

Herdz.io is a real-time multiplayer game. To ensure smooth and enjoyable gameplay, matches may be filled with computer-controlled players ("bots") — for example when there are not enough human players available, during periods of low connectivity, or to give new players a good introduction to the Game.

9. Virtual items & purchases

The Game includes virtual currency (Lumens and Gems) and cosmetic items ("Virtual Items"). The following applies to all Virtual Items, whether purchased, earned, or granted:

Virtual Items are a limited, personal, revocable licence to use features within the Game. They are not your property, have no monetary value, are not legal tender, and cannot be redeemed for real money.
Virtual Items cannot be transferred or sold between accounts or to other people, and may only be used within your own account.
All purchases are final and non-refundable, except where a refund is required by law.
Because Virtual Items are delivered immediately, by purchasing you expressly request immediate performance and acknowledge that you lose any statutory 14-day right of withdrawal once delivery begins.
Prices may change at any time before you purchase, and may vary by region, exchange rate, and taxes.
Payments are processed by our payment provider, Xsolla. We do not process or store your card or bank details. If you have a payment problem, contact Xsolla or your bank. We are not liable for unauthorised purchases made through your account or device, including by minors.
We may expire, withdraw, replace, or restrict Virtual Items, and may remove them or suspend access without refund (except at our discretion or as required by law) if we detect fraud, chargebacks, cheating, or a breach of these Terms, or if your account is inactive for 24 months.

10. Availability, disclaimers & liability

The Game is provided on an "as is" and "as available" basis. We do not guarantee that it will always be available, uninterrupted, timely, secure, or free from bugs, errors, or cheating, and we may change, suspend, or discontinue features without notice.

To the maximum extent permitted by law, we are not responsible for: loss or damage caused by events beyond our reasonable control; loss of data or progress not caused by our failure to use reasonable care and skill; the actions of other players; or loss that is indirect or that neither of us could reasonably have foreseen. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. If you are a consumer, your mandatory statutory rights are not affected by these Terms.

11. Third-party links & advertising

The Game may contain links to, or advertising provided by, third parties. We do not control and are not responsible for third-party websites, content, or advertisements, which are governed by their own terms and privacy policies. If you find an advertisement inappropriate, please report it to support@herdz.io.

12. Intellectual-property complaints

If you believe content in the Game infringes your intellectual-property rights, please contact support@herdz.io with details and we will investigate.

13. If the Game closes (sunset)

We may decide to discontinue the Game. If we do, we will give reasonable notice in the Game or on the website. You will be entitled to a refund of purchases of Virtual Items made in the two (2) months before the closure date, provided you claim within 30 days of that date by contacting support@herdz.io. After that period we may permanently delete game data in line with our Privacy Policy.

14. Governing law & disputes

These Terms, and any dispute arising out of or relating to them or the Game, are governed by the laws of Germany, and the courts of Germany will have jurisdiction. If you are a consumer resident in the European Economic Area, you also benefit from the mandatory consumer-protection provisions of the country where you live, and you may be able to bring proceedings, or use a local alternative dispute-resolution body, there. We will always try to resolve any issue informally first — please contact support@herdz.io.

15. General

You may not assign or transfer your rights or obligations under these Terms. If any part of these Terms is found invalid or unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms are the entire agreement between you and us regarding the Game and supersede any prior terms. A person who is not a party to these Terms has no rights under them.
